Abstract
The development and form of the factoring contract and forfeiting contract confirm in a convincing way the view according to which the business life is much richer than law, which means that the legislator is often not able to encompass through legal regulations all the business relationships which occur between business legal subjects on the market. The business system has favorable effects on business cooperation even on the international level through new contracting business forms incurring in the field of autonomous business law. The diverse market and technological pressures are forcing the business subjects to turn to different modalities of modern business, among which factoring and forfeiting business occupy special positions. Having in mind the fact that a large number of factoring and forfeiting contracts have been concluded in the field of banking business, which is characterized by exceptional dynamics, it is logical that the importance of these unnamed business forms is great for all environments which respect the market principles of business.
