Abstract
The aim of the article was an attempt to answer the question of whether and how the legislature to protect
consumers in relation to the risks associated with the acquisition of novel foods and depositing it on the
market. The innovations allow to obtain the novel food, which is the subject of EU’s regulation. The legislator
ensures its safety and if it is necessary it bans its market implementation. It particularly concerns the food
obtained from cloned animals. Both food safety and food security should be prioritized by the lawmakers.
