La importancia del consumidor en el sistema o complejo agroalimentario, del cual es el último eslabón o estadio, no requiere mayor justificación. Esta importancia se bifurca en una doble vertiente, económica y jurídica, que hacen que el estudio de su protección sea altamente interesante. Lo anterior se comprende si se piensa, entre otras cosas, que en esta materia entran en juego no sólo aspectos de tutela de los diferentes protagonistas del sector agroalimentario (productores, transformadores, distribuidores, consumidores), sino, más específicamente, aspectos que tienen mucho que ver con derechos fundamentales estampados en nuestra Constitución, como el derecho a la vida, el derecho a la salud, el derecho a la integridad física, etc. En el presente trabajo se trata de abordar, de forma somera, una aproximación a las diferentes normas (de la Unión Europea, Estatales y Autonómicas) que conforman el entramado protector del consumidor no sólo desde la perspectiva estrictamente administrativa, sino también desde el prisma de la responsabilidad penal. En ambos grupos de normas se aprecia, de forma clara, la finalidad de las misma, que no es otra que la salvaguardia de esos dos aspectos, económico y jurídico, antes mencionados.....The importance of consumer in the agrifood system, of which it is the last step, doesn’t need further defention. This importance is branched in a double aspect, economic and legal, that make that the study of their protection highly interesting. This is understood if we think, among other things, that in this subject there are not only legal aspects of the different agrifood sector characters (producers, transformers, dealers, consumers), but also, more specifically, aspects related to fundamental rights gathered in our Constitution, as live right, health right, physical integrity right, etc. In the present work we tackle, briefly, an approach to different norms (of European Union, National, Autonomic) that conform the protective framework of the consumer, not only from strictly administrative point, but only from penal liability point. In both groups of norms is appraised, clearly, their purpose, that is the safeguard of these two aspects, economic and legal, mentioned before.
