Abstract

Milk regulation in North Carolina is extensively analyzed, including regulations affecting producer prices, classification of milk, base provisions, and interplant and interstate milk movements. Also reviewed are regulations affecting processor and retailer prices, the rationale for milk regulation, and some aspects of federal market ing orders. In addition, there is a legal analysis of the leading constitutional court challenges to state milk commissions in the Southeast. In several instances state milk commissions have had their regulations declared unconstitutional because of the Interstate Commerce Clause in the U.S. Constitution.
